Theatre licence

Conditions of licence

  1. The number of persons admitted to the premises at any one time shall not exceed:  the maximum allowed in terms of the Building Standards (Scotland) Regulations 1981 and any provisions made by the Firemaster in terms of the Fire Precautions Act 1971.
  2. The licence-holder shall display this licence at all times at the above premises.
  3. The licence-holder shall not in any way alter, erase or deface this licence, and shall when reasonably required, produce it for examination by the Head of Administration and Legal Services, South Lanarkshire Council.
  4. The licence-holder shall comply with any order or instruction given by any constable for the prevention of annoyance to the public or to the occupiers of any premises or in connection with any emergency or disturbance (including an order or instruction to close the premises for a limited period) or on any occasion when such constable in his discretion may consider it necessary in the public interest to give such order or instructions.
  5. The licence-holder shall collect and remove any paper, garbage or other refuse which may be produced or which may accumulate in the course of any performance at the above premises.
  6. The noise level emanating from the premises shall not, when measured within any residential accommodation within the vicinity of the premises, at any time between the hours of 7 pm and 7 am exceed 35 decibels on the A-weighted Scale, and the licence-holder shall comply with any order, instruction, intimation or notification given to him in this respect by the appropriate Department of the Council.
  7. No person shall give an exhibition, demonstration or performance of hypnotism on any living person at or in connection with any performance in the premises to which the public are admitted, unless there is posted, in a prominent position within the premises a notice clearly giving warning to the public of the possible dangers involved, in terms as specified by the Council.  If any member of the public at that time does not then wish to be admitted to the performance, then it shall be a condition of this Licence that that person shall have refunded to him/her prior to the commencement of the performance any money which may previously have been paid by him/her to the promoter of the performance by way of admission to the performance.
  8. Where the above premises cease to be used for the performance of plays for more than two months of the unexpired period of this licence, or where the licence has expired, the holder of the licence shall within seven days thereafter, give notice thereof to the Council and deliver his licence to the Head of Administration and Legal Services, South Lanarkshire Council at which time the licence shall be deemed to have been cancelled in terms of Paragraph 5 of Schedule 1 to the 1968 Act, and it shall be a contravention hereof if he shall fail to deliver his licence within said period of seven days.
  9. It is a condition of the grant of this licence that any requirements specified by Scottish Fire and Rescue in relation to the above premises shall be complied with and adhered to during the currency of this licence.
  10. The licence-holder shall maintain in force at all times adequate and sufficient third party liability insurance for the above premises.
  11. It is a condition of the grant of this licence that all sockets located in the parts or areas of the above premises (including in particular any stage area) where any musical equipment, discotheque equipment, lighting equipment, amplification equipment or video equipment or the like is used or is likely to be used in the course of the entertainment or recreation at the premises, shall, as a minimum requirement, be fitted with and protected by 13A Double Role Residual Current Circuit Breakers of 30MA sensitivity with advanced circuitry made to BS4293 1983.
  12. It is a condition of the grant of this licence that you will at all times comply with any reasonable requests by Scottish Fire and Rescue Services in connection with the activities carried out by you or anyone associated with you under the terms of this licence.
  13. It is a condition of the grant of this licence that you will at all times comply with any reasonable requests by Planning Services in connection with the activities carried out by you or anyone associated with you under the terms of this licence.
  14. It is a condition of the grant of this licence that you will at all times comply with any reasonable requests by Building Standards in connection with the activities carried out by you or anyone associated with you under the terms of this licence.
