SummaryA Drug Treatment and Testing Order (DTTO) is a statutory order which is available to the courts where an individual’s drug dependency problems are considered to be a significant factor in offending behaviour. A DTTO is an Order made under section 234B of the Criminal Procedure (Scotland) Act 1995 (as inserted by section 89 of the Crime and Disorder Act 1998). A DTTO has been available to the court as an alternative to a custodial disposal since 2004.

South Lanarkshire Justice Services manage DTTO’s for the whole of the South Lanarkshire area and nursing support is provided by CAReS. The emphasis of a DTTO is on drugs treatment as the main way of reducing offending behaviour. Key objectives are to reduce or stop an individual’s dependency or the likelihood of misusing drugs, and to achieve positive changes in the scale and frequency of drug related offending.

A consequence of Covid-19 has been increased instability in treatment across addiction services including DTTO. As part of justice covid recovery the DTTO service will be enhanced through third sector provision from We Are with You until end March 2022. This will provide an outreach aspect to DTTO provision to support service users to attend appointments, support compliance and build confidence to engage with other services. The additionality to DTTO service from We Are With You will provide additional support to help sustain individuals in treatment and provide a proactive and flexible response to individual need.

There was a need identified for a PIA due to the processing of personal data. It was identified that the information included personal data, special category personal data and may include personal data relating to criminal convictions/offences. Thorough consideration has been taken in relation to the sharing of the relationship and vulnerability of the data subject, the categories of personal data and the legislation which gives the council the powers to process the information. An assessment of the overall level of risk in relation to sharing the information has also been considered.
